SALARY:The salary range for this position is $79,098\.16 to $123,272\.27 for Schedule A, and $79,098\.16 to $117,108\.66 for Schedule B. For newly hired individuals, the starting salary will normally be at the minimum of the salary range. For current Judiciary employees, salary upon promotion or advancement will be an increase of 5% of base salary, not to exceed the maximum of the range, or the minimum salary of the band/level, whichever is greater.Judiciary employees hired prior to June 3, 2014, are considered Schedule A. Newly hired individuals, and Judiciary employees hired on or after June 3, 2014, are considered Schedule B. *The Judiciary offers a strong opportunity for growth.*

    The New Jersey Judiciary is seeking a motivated, highly organized, and detail\-oriented attorney to undertake critical responsibilities, under the direction of the Chief and Assistant Chief of Labor and Employee Relations in the Administrative Office of the Courts (AOC). The selected candidate will be primarily responsible for responding to and addressing AOC employee requests for reasonable accommodations under the Americans with Disabilities Act (ADA), Pregnant Workers Fairness Act (PWFA), and the New Jersey Law Against Discrimination (LAD). The selected candidate will engage employees in the interactive process, coordinate with various stakeholders to secure appropriate accommodations, draft decisions, and maintain detailed records related to such requests. The selected candidate will also be responsible for responding to and addressing employee requests for extended remote work through the Judiciary’s internal extended remote in exceptional circumstances program.

    The role will also support the implementation of important policy initiatives and ensure alignment with applicable laws and policies. Familiarity with the New Jersey "State as a Model Employer of People with Disabilities" (SAME) Program is a plus.

    The selected candidate will be expected to conduct complex legal research assignments related to the ADA, PWFA, LAD, as well as general employment and labor law. The role will also represent management in proceedings, support labor negotiations, and analyze workforce data to inform decision\-making.

    REMOTE WORK: The Judiciary currently offers a hybrid work schedule, and this position may qualify for up to 2 days of remote work outside of Judiciary buildings. To participate in this program, in addition to installing a multifactor authentication app on your phone or tablet, you will be required to have high speed home internet access.

  • Act as the Local Title I ADA Coordinator for the Central Office. Review and facilitate reasonable accommodation requests pursuant to the ADA. Engage requesting employees in the interactive process throughout the accommodation process. Act in a similar capacity for reasonable accommodation requests made pursuant to the PWFA and LAD. Assist the Assistant Director of Human Resources with ADA appeals.
  • Act as the AOC Extended Remote in Exceptional Circumstances Coordinator. Review medical documentation submitted for sufficiency according to policy rules, communicate with the requesting employee and local management on the status of the request, and submit requests for determination.
  • Serve as the lead in developing and implementing the SAME program. Once established, collaborate with stakeholders to ensure program compliance. Serve as the SAME subject matter expert by answering questions, analyzing and reviewing pending legislation that may impact SAME, and making recommendations to senior management regarding whether to comment on such legislation.
  • Conduct complex legal research, including analysis of statutes, case law, court rules, and policies, to advise senior management on legal issues such as the ADA, PWFA, LAD, and state and federal Family and Medical Leave Acts. Conduct additional legal research related to employment and labor law as needed. Draft and update policies as necessary.
  • Represent AOC management in minor disciplinary matters and grievance hearings before hearing officers. Responsibilities include preparing legal briefs and exhibits, addressing evidentiary issues, drafting opening and closing statements, preparing questions for direct and cross\-examination, and preparing witnesses for testimony. Negotiate and draft settlement agreements related to such matters.
  • Participate in collective negotiations, including Collective Negotiation Agreements, side letters, and Memoranda of Understanding, by preparing article proposals.
  • Maintain and conduct data analytics on current, pending and anticipated disciplinary actions.
  • Regular and predictable physical presence at the worksite is an essential function of this position.

    Qualifications

  • Graduation from an American Bar Association\-approved law school and one year of experience in legal research and analyzing and evaluating legal documents, rules, regulations, and/or legislation.

    Substitution: One year of experience as a Judicial Law Clerk may be substituted for one year of the required experience.

    License: Attorney\-at\-Law with a plenary license in the State of New Jersey and having Supreme Court Good Standing Status of Active.

Driver's License: Appointees will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle is necessary to perform essential duties of the position.

Authorization to Work: US citizenship is not required. Selected candidate must be authorized to work in the US according to Department of Homeland Security, US Citizenship and Immigration Services regulations.

Residency Law: In accordance with N.J.S.A. 52:14\-7 (L. 2011, Chapter 70\), the "New Jersey First Act," all persons newly hired by the Judiciary within one year must establish, and then maintain, principal residence in the State of New Jersey. Any person may request an exemption from that requirement from the Employee Residency Review Committee in the Department of Labor \& Workforce Development on the basis of either hardship or employer critical need.
